W. Va. Circuit Court Denies Class Certification to Rezulin Plaintiffs

BECKLEY, W.Va. - A West Virginia circuit court has concluded that several plaintiffs seeking to certify a Rezulin class action lawsuit did not present a scientific basis for claims of latent liver injury or the need for medical monitoring. McCaffery, et al. v. Warner-Lambert Co., et al., No. 00-C-1180-H (W. Va. Cir. Ct., Raleigh Cty.).
In its Nov. 26 decision, the court wrote that, because Rezulin had been effective for each proposed class representative without any serious side effects, the plaintiffs were not typical of any possible class member who might have a product liability or Consumer Protection Act claim....
