MONTGOMERY, Ala. -- The Alabama Trial Lawyers Association has filed an amicus curiae brief in a dispute over the constitutionality of Alabama's two-year statute of limitations, urging the court to adopt a 'true discovery rule.' Cline v. Ashland Inc., et al., No. 1041076 (Ala. Sup. Ct.).
The May 11 brief was filed upon request by the Alabama Supreme Court, which has already heard oral arguments on the question of whether a benzene plaintiff was denied due process when a trial court found his claims were barred by the statute of limitations.
