GREENVILLE, Miss. - Defendants in a Mississippi benzene action have filed a summary judgment motion, claiming that because the decedent had children, his siblings are precluded from bringing the wrongful death claims. Jenkins, et al. v. First Chemical Corp., et al., No. CI2004-238 (Miss. Cir. Ct., Washington Cty.).
The defendants filed the summary judgment motion on Feb. 13 in the Mississippi Circuit Court for Washington County.
Plaintiffs Simuel Jenkins, Missie Acoff and Princy Williams filed the wrongful death action on behalf of their brother, Percy Jenkins, who they claim died as a result of benzene exposure.
