Federal Court Remands Several Benzene Proceedings

EL DORADO, Ark. -- A federal court has remanded several benzene claims, stating that precluding plaintiffs from asserting a cause of action for failure to comply with federal regulations would be unreasonable. Curry, et al. v. Aervoe Industries, et al., No. 05-1058; West, et al. v. Aervoe Industries, et al., No. 05-1099 (W.D. Ark.).

The U.S. District Court for the Western District of Arkansas also stated in the March 3 order that precluding such claims would allow manufacturers to avoid punishment for inadequately labeled products.
