Dow Says Causation Lacking, Property Owner Immunity Precludes Claims

ANGLETON, Texas -- Dow Chemical is awaiting a hearing on three separate summary judgment motions in a benzene lawsuit, asserting a lack of causation, workers' compensation and property owner immunity. Boren, et al. v. Dow Chemical Co., et al., No. 17958 (Texas 239th Jud. Dist. Ct., Brazoria Cty.).

Sources told HarrisMartin that while the claims of plaintiffs James and Ginger Boren were set to be tried in April, Dow Chemical, the lone defendant left in the case, was recently granted a continuance.
