Okla. Federal Judge Refuses to Dismiss Pedicle Screw Action Against NuVasive

OKLAHOMA CITY — An Oklahoma federal judge has allowed a lawsuit targeting NuVasive’s pedicle screw system to proceed, finding the plaintiffs have adequately alleged that the devices were defective and led to their injuries.
In an April 15 order, Judge Stephen Friot of the U.S. District Court for the Western District of Oklahoma further held that dismissal at this stage of the litigation would be premature.
Gina Kolar underwent lumbar fusion surgery on Nov. 7, 2017, during which her doctor used seven components, two of which were pedicle screws manufactured by NuVasive.
