U.S. Sup. Court Declines Review of MDL Plaintiffs' Remand Petition




WASHINGTON, D.C. - The U.S. Supreme Court has refused to review a Third Circuit ruling that denied various asbestos-exposed plaintiffs' motion to remand from the MDL claims seeking damages for personal injury and wrongful death. In re: Joann Patenaude, et al., No. 00-281 (U.S. Sup. Ct.).

The high court issued its denial of the petition for writ of certiorari on Nov. 27 without comment.

The petitioners were appealing from the Third Circuit U.S. Court of Appeals' denial of a writ of mandamus on the finding that remand of petitioners' claims was not proper given that individual settlement negotiations and conferences …
