Stryker Hip Replacement Action Survives Dismissal Motion in Texas

HOUSTON — A Texas federal judge has allowed strict liability, negligence and breach of warranty claims to proceed in a Stryker hip replacement action, ruling that the plaintiff adequately alleged design and manufacturing defects in the acetabular shell and bone screws she received.
In an Oct. 7 order, Judge Keith P. Ellison of the U.S. District Court for the Southern District of Texas further found the plaintiff adequately pled that Stryker failed to warn her surgeon of known defects associated with the acetabular shell, bone screws, and other components.
