Missouri Appellate Court Says Talc Ovarian Cancer Appeal Properly Before Court, Reverses $110 Million Verdict

ST. LOUIS –– A Missouri appellate court has reversed a $110 million talcum powder ovarian cancer verdict, again finding that the trial court lacked personal jurisdiction over the plaintiffs under the U.S. Supreme Court’s Bristol-Myers Squibb decision.

In the Oct. 15 opinion, the Missouri Eastern District Court of Appeals rejected the plaintiffs’ position that the case was not properly before the appellate court, concluding that the trial court lacked the authority to decertify the case for appeal.
