N.Y. Appellate Court Blocks State’s Enforcement of Ban on Vaping Products

ALBANY, N.Y. — A New York appellate court has granted a national trade association’s request to block state officials from enforcing a ban on flavored vape products one day before it was scheduled to take effect.

In an Oct. 3 order, the New York Supreme Court, Appellate Division 3rd Department stayed enforcement of the ban, entitled "Prohibition on the Sale of Electronic Liquids with Characterizing Flavors," pending a trial court’s ruling on Vapor Technology Association (VTA)’s motion for a preliminary injunction.
