N.Y. Court Tosses Asbestos Claims Against Defendant, Cites Lacking Jurisdiction

NEW YORK –– A New York trial court has granted an asbestos defendant’s motion to dismiss, concluding that it could not assert either general or specific jurisdiction over the company and concluding that “more is required than just an injury in New York.”

In the Sept. 13 order, the New York Supreme Court for New York County opined that the plaintiff had failed to establish that the defendant had regularly done, or solicited business, in the state.

The plaintiffs asserted the claims on behalf of Darrell Nelson, contending that his mesothelioma was, in part, caused by exposure to asbestos-containing carburetors …
