Plaintiff in Pa. Cosmetic Asbestos Talc Case Oppose Efforts to Continue Trial Setting, Cites Declining Health

PITTSBURGH –– A plaintiff asserting cosmetic asbestos talcum powder claims is opposing efforts by defendants to push back a 2020 trial setting, maintaining that an earlier trial setting would be appropriate, given the plaintiff’s declining health.

In the Sept. 23 opposition brief filed in the Pennsylvania Court of Common Pleas for Allegheny County, the plaintiff explained that the court’s assignment of the claims to a May 2020 trial setting should stand since she is a “very young individual living with mesothelioma,” who is required to have “her lungs drained three times a week.”
