Defendant Named in PCB Exposure Suit Removes Case, Cites ‘Complete Diversity of Citizenship’

FLORENCE, S.C. –– A defendant named in a PCB exposure lawsuit has removed the case to South Carolina federal court, contending that the court has jurisdiction in the matter “in light of the amount in controversy and the complete diversity of citizenship.”

On Sept. 11, defendant Highland Industries Inc. removed the case to the U.S. District Court for the District of South Carolina, contending that the plaintiff has “fashioned her complaint as a class action,” and, further, that the parties in the action are completely diverse.
