Strict Products Liability Claim Proceeds in Ill. Federal Hip Case

PEORIA, Ill. — An Illinois federal judge has refused to dismiss a strict products liability claim asserted in a Smith & Nephew hip case, ruling that the plaintiff adequately alleged the faulty condition of her device caused her injuries.

However, in the Sept. 13 order, Judge James Shadid of the U.S. District Court for the Central District of Illinois dismissed the plaintiff’s breach of warranty and negligence claims as inadequately pled but gave her 21 days to amend the complaint.
