Lawsuit Accusing Juno Therapeutics of Concealing Risks of Clinical Trial to Proceed

HOUSTON — A Texas federal judge has refused to dismiss a lawsuit accusing Juno Therapeutics Inc. of failing to adequately warn a patient of the true risks of its cancer drug clinical trial, ruling that the question of whether the learned intermediary doctrine bars the claims must be fully briefed.

In a June 21 order, Judge Lee H. Rosenthal of the U.S. District Court for the Southern District of Texas further found the plaintiffs adequately alleged that Juno negligently and fraudulently failed to warn the deceased and her family of the risks of severe cytokine release syndrome and severe neurotoxicity.
