Contaminated Olympus Scope Lawsuit to Proceed in Colo. Federal Court

DENVER — A Colorado federal judge has refused to dismiss a lawsuit seeking damages for injuries caused by an allegedly contaminated duodenoscope, ruling that jurisdiction exists over Olympus Medical Systems Corp. because it had sufficient contacts with the state.
In a June 5 order, Magistrate Judge Nina Y. Wang of the U.S. District Court for the District of Colorado also held that the plaintiff adequately pled her claims of strict liability, negligence, and misrepresentation.
