Illinois Courts May Hear Multi-Plaintiff Essure Case, Appellate Court Affirms

MOUNT VERNON, Ill. — Illinois courts have jurisdiction over Bayer Corp. in a multi-plaintiff Essure birth control case because the claims arose, at least in part, from the company’s contacts with the state, an Illinois appellate court has affirmed.

In a May 29 order, the Illinois Court of Appeals, 5th District, further ruled that litigating the action in Illinois would not be unreasonable because the state has an undeniable interest in resolving a dispute arising, in part, from clinical trials held in Illinois, by Illinois doctors, in Illinois facilities.
