CHICAGO — The U.S. Supreme Court has declined to review a federal appellate panel’s determination that claims accusing GlaxoSmithKline of failing to strengthen Paxil’s warning label are preempted by federal law.
In a Dec. 20 petition for writ of certiorari, the plaintiff sought to challenge the 7th Circuit U.S. Court of Appeals’ determination that her claims are preempted because federal law would have prevented GSK from adding a warning that Paxil can cause suicide in adults.
