Plaintiffs Oppose Motion for Federal-State Coordination Order in BHR Hip MDL

BALTIMORE — Plaintiffs in the Birmingham Hip Resurfacing multidistrict litigation have opposed Smith & Nephew’s motion for an order coordinating the federal litigation with parallel state court proceedings, arguing that such an order is not warranted given the small number of state cases.

In their May 13 opposition filed in the U.S. District Court for the District of Maryland, the plaintiffs propose that instead of “bringing the heavy hand of the federal judiciary down on a few state court judges and plaintiffs,” the MDL court send a letter to the few state court judges with pending S&N cases.
