Wash. Court Reverses Order Tossing Asbestos Claims on Statute of Repose Grounds, Says Premises Owner-Related Claims Can Proceed

SEATTLE –– A Washington appellate court has reversed in part an order tossing asbestos claims on statute of repose grounds, ruling that while the plaintiffs could not bring claims against the defendant for construction-related activities, claims arising out of the defendant’s role as a premises owner could proceed.

In the May 13 order, the Washington Court of Appeals, Division One, wrote that the trial court should “not have dismissed [the plaintiffs’] claims arising out of PacifiCorp’s status as a premises owner as barred by the statute of repose.”
