Calif. Appeals Court Denies Monsanto’s Request to Take Notice of Op Ed Articles, Juror Correspondence

SAN FRANCISCO — A California appellate court has denied Monsanto Co.’s motion to take judicial notice of newspaper articles and jurors’ correspondence in the appeal of a $289 million Roundup verdict, explaining that they are not part of the trial court’s record.

In a May 10 order, the California Court of Appeal, 1st District, also denied a juror’s request to redact personal information from any future releases of the correspondence and to sanction Monsanto for intentional release of the personal information. The court explained that the request does not conform to rules governing confidentiality.
