DePuy ASR Hip MDL Judge Dismisses Spaniards’ Cases on Forum Non Conveniens Grounds

CLEVELAND — The Ohio federal judge overseeing the DePuy ASR hip MDL docket has dismissed several cases filed by Spanish residents, ruling that the actions should be tried in Spain, where the surgeries and associated medical care took place.

In orders filed April 30 and May 1, Judge Jeffrey J. Helmick of the U.S. District Court for the Northern District of Ohio explained that “the Spanish legal system provides multiple causes of action that would enable Plaintiffs to obtain relief for injuries asserted in their complaint, including claims based on negligence as well as Spain’s product liability law.”
