Ark. Federal Judge Retains Jurisdiction over Biomet M2a Hip Case

TEXARKANA, Ark. — An Arkansas federal judge has retained jurisdiction over an M2a Magnum hip action, ruling that although the plaintiff’s surgeries took place in a different jurisdiction, Biomet waived venue and therefore it would be inappropriate to sua sponte dismiss or transfer the case.

In an April 22 order, Chief Judge Susan O. Hickey of the U.S. District Court for the Western District of Arkansas noted the parties agreed that the Western District of Arkansas is an appropriate venue because the plaintiff was a resident in that district at the time of the alleged injuries and surgeries.
