Civil Conspiracy Claim Proceeds Against Bank in S.C. Trust Action

COLUMBIA, S.C. — A South Carolina federal judge has denied U.S. Bank National Association’s motion for summary judgment on a civil conspiracy claim in a lawsuit accusing of breaching its duties as the trustee of an account securing an insurer’s liabilities in a fronting program.

In a March 22 order, Judge J. Michelle Childs of the U.S. District Court for the District of South Carolina found a question of fact exists as to whether U.S. Bank was part of a combination of two or more entities that carried out an unlawful act, causing Accident Insurance Co.’s damages.
