Calif. Court Remands Asbestos Default Judgment Dispute Back to Trial Court, Asks for Clarification on Order

SAN FRANCISCO –– A California appellate court has remanded an asbestos dispute asking the court for further clarification on how it exercised discretion in granting an insurance company’s motion for relief from the default judgment.

In the Feb. 19 opinion, the California Court of Appeal, First Appellate District, Division Two, found that it could not tell when the insurance company located the policy it allegedly issued to the asbestos defendant, or when it discovered that judgment had been entered in the case.
