N.Y. Appellate Court Reverses Order Denying Summary Judgment to Asbestos Defendant

NEW YORK –– A New York appellate court has reversed the denial of summary judgment in an asbestos case, finding that the plaintiff had failed to show that conducting discovery on the continuity of ownership of a defendant company “would be anything other than a fishing expedition.”
In a Feb. 19 order, the New York Supreme Court, Appellate Division, found that “plaintiff failed to raise an issue of fact as to continuity of ownership.”
