Tenn. Appellate Court Affirms Summary Judgment for Norfolk Southern in Lung Cancer Asbestos Case

KNOXVILLE, Tenn. –– A Tennessee appellate court has affirmed summary judgment in favor of Norfolk Southern Railway in an asbestos lung cancer case, finding that the trial court did not err when it excluded lay testimony regarding the presence of asbestos.

In the Feb. 12 opinion, the Tennessee Court of Appeals concluded that “it may not be inferred from Decedent’s lung cancer alone that Decedent was exposed to asbestos or that Norfolk Southern was negligent.”
