La. Court Denies Asbestos Defendants’ Motion for Summary Judgment, Says Questions of Fact Exist

NEW ORLEANS –– A Louisiana federal court has denied efforts from two asbestos defendants to obtain summary judgment, concluding that the plaintiff has established that he will present admissible expert testimony linking the defendants’ products to his alleged asbestos-related injury.
In the Jan. 7 order, the U.S. District Court for the Eastern District of Louisiana concluded that “whether to credit this testimony is a question of fact for the jury.”
Plaintiff Victor Michel filed the underlying claims, contending that he developed peritoneal mesothelioma as a result of exposure to asbestos-containing products he encountered while working as a mechanic.
