R.I. Court Retains Jurisdiction of Asbestos Suit, Finds Removal by CBS Timely

PROVIDENCE, R.I. –– A Rhode Island federal court has retained jurisdiction over an asbestos case, finding that the plaintiff only recently disclosed specific CBS Corp. products linked to the decedent’s service in the U.S. Navy.

In the Jan. 9 opinion, the U.S. District Court for the District of Rhode Island said that while CBS could have guessed that the case was removable prior to late last year, information in papers filed by the plaintiffs did not establish a basis for removal until September 2018.
