Calif. Federal Judge Dismisses ALN IVC Filter Case With Leave to Amend

SAN JOSE, Calif. — A California federal judge has dismissed with leave to amend a lawsuit targeting ALN International Inc.’s IVC filter, ruling that the claims of strict products liability, negligent misrepresentation and breach of express warranty were inadequately pled.

On Dec. 3, Judge Beth Freeman of the U.S. District Court for the Northern District of California further held that the plaintiff failed to plead her claims of fraud and punitive damages with the requisite specificity.
