Prisco Inc. Supports Motion to Dismiss Benzene Claims, Insists Evidence is ‘Insufficient’ to Establish Personal Jurisdiction

BIRMINGHAM, Ala. –– A company named as a defendant in a benzene action has filed a reply brief supporting its motion to dismiss, maintaining that the complaint has not, and cannot, allege that the company is at home in Alabama since it is a New Jersey corporation.

In the Nov. 13 reply brief filed in the U.S. District Court for the Northern District of Alabama, Prisco argued that the plaintiffs “make no effort to show this is an exceptional case in which Prisco’s contacts with Alabama are ‘so constant and pervasive’ as to render it ‘essentially at home.’”
