Boston Scientific IVC Filter Case Survives Dismissal Motion in Ill. Federal Court
November 29, 2018
SPRINGFIELD, Ill. — An Illinois federal judge has denied Boston Scientific Corp.’s motion to dismiss a lawsuit targeting its Greenfield IVC filter, ruling that the plaintiff has sufficiently alleged that the device was defectively designed and manufactured and accompanied by inadequate warnings.
In a Nov. 27 order, Judge Richard Mills of the U.S. District Court for the Central District of Illinois also found the plaintiff adequately pled that BSC negligently breached its duty of care by selling a device that is unreasonably dangerous, and that the filter is not fit for the ordinary purpose for which it is used.
