Texas Federal Court Dismisses Asbestos, Benzene Claims Against BNSF With Prejudice

FORT WORTH, Texas –– A Texas federal court has granted BNSF Railway’s no-evidence motion for summary judgment with prejudice in an asbestos and benzene exposure lawsuit, concluding that the plaintiff had failed to provide specificity with regard to her claims.

In the Nov. 27 order, the U.S. District Court for the North District of Texas ruled that “all claims and causes of action asserted by plaintiff against defendant” were dismissed with prejudice.
