N.Y. Court Dismisses Several Claims in Asbestos Talcum Powder Suit Against Colgate-Palmolive

NEW YORK –– A New York court has dismissed several counts asserted in an amended asbestos talcum powder on statute of limitations and pleading specificity grounds.

In a Nov. 1 order, the New York Supreme Court for New York County severed and dismissed claims for breach of warranty, premises liability, labor law and NYS industrial code violations, liability for contractors and subcontractors, liability for dust mask defendants, and civil conspiracy and fraud.

Plaintiff Shirley Niemeyer filed the underlying lawsuit, contending that she developed mesothelioma as a result of exposure to asbestos fibers present in Cashmere Bouquet cosmetic talc. Niemeyer stated …
