Calif. Couple May Amend Claims in Medtronic Insulin Pump Case, Federal Judge Rules

SACRAMENTO, Calif. — A California federal judge has allowed a couple to amend their claims of products liability in which they allege that a defective Medtronic insulin pump caused their daughter’s death.

In an Oct. 29 order, Chief Judge Lawrence O’Neill of the U.S. District Court for the Eastern District of California further held that the plaintiffs may amend their claims of negligence and breach of implied warranty.

Denise and Josef Gomez filed suit on May 1 in the Fresno County Superior Court, alleging that Medtronic’s MiniMed Infusion Set caused their daughter Emma to become unconscious, leading to her death. …
