N.H. Court Allows Some Discovery of Plaintiff Medical Histories in Water Contamination Suit

CONCORD, N.H. –– A New Hampshire federal court has limited discovery of medical history of plaintiffs involved in a water contamination suit, saying that while the defendants’ original requests were overbroad, several other courts have asked plaintiffs in medical monitoring actions to “produce at least some portion of medical history.”

According to the Oct. 10 order issued by the U.S. District Court for the District of New Hampshire, the defendants named in the action had requested production of the named plaintiffs’ medical, employment, and workers’ compensation records.
