PHILADELPHIA –– The 3rd U.S. Court of Appeals has denied a petition for rehearing filed in the appeal of a talcum powder class action, opting not to revisit its recent order affirming the dismissal of the claims.

In a two-page Oct. 3 order, the 3rd Circuit stated that “no judge who concurred in the decision having asked for rehearing, and a majority of the judges of the circuit in regular service not having voted for rehearing, the petition for rehearing by the panel and the Court en banc, is denied.”
