N.J. High Court Dismisses Accutane Cases, Says IBD Warnings Adequate Under N.J. Law

TRENTON, N.J. — The New Jersey Supreme Court has dismissed hundreds of Accutane cases, ruling that under New Jersey law, the plaintiffs have failed to overcome the presumption of adequacy attached to the drug’s warnings regarding inflammatory bowel disease.

In an Oct. 3 opinion, the high court rejected an appellate court’s determination that the law of the plaintiffs’ home states apply to the claims, holding that New Jersey law applies “because New Jersey is where the alleged conduct causing the injury occurred — the manufacturing and labeling of Accutane.”
