Manufacturing Defect, Warning Claims Survive Dismissal Motion in Profemur Hip Case

HARTFORD, Conn. — A Connecticut federal judge has allowed a manufacturing defect and failure to warn claims to proceed in a Wright ProfemurZ hip case, finding the plaintiffs adequately alleged that the device did not meet industry standards and was not accompanied by adequate warnings.

However, in the Sept. 14 order, Judge Janet Arterton of the U.S. District Court for the District of Connecticut dismissed the design defect and negligence claims as inadequately pled.

Edward Karazin underwent total hip replacement surgery on March 30, 2005, during which his surgeon implanted Wright’s Profemur Z artificial hip system.
