46 Biomet M2a Hip Implant Cases Remanded to Plaintiffs’ Home Districts

SOUTH BEND, Ind. — The judge overseeing the Biomet M2a hip multidistrict litigation docket has transferred 46 cases to the plaintiffs’ home districts, explaining that they will no longer benefit from pretrial proceedings.

In a Sept. 6 order, Judge Robert L. Miller Jr. of the U.S. District Court for the Northern District of Indiana said the cases will no longer benefit from centralized proceedings and that the plaintiffs’ home courts should try the remaining case-specific issues, such as timeliness and spoliation.

No plaintiff has consented to trial of cases in the MDL court, the judge added.
