Talcum Powder Class Action Plaintiffs Seek Remand, Say J&J Already Agreed Case Belongs in State Court

NEWARK, N.J. –– Plaintiffs asserting class action claims against Johnson & Johnson for what they say is the false advertising of talcum powder products have asked the national multidistrict litigation court to remand their case, saying that the parties had previously agreed that the case did not belong in federal court.

In the Sept. 4 filing in the U.S. District Court for the District of New Jersey, the plaintiffs maintained that the federal court does not have the ability to adjudicate the case, given its prior determination in a similar case that the plaintiffs do not have Article III standing.
