Pa. Court Dismisses Benzene Suit on Forum Grounds, Says Case Should be in Carolinas

PHILADELPHIA –– A Pennsylvania state court has dismissed a benzene suit on forum non conveniens grounds, accepting one defendant’s position that the case has a stronger connection to either North Carolina or South Carolina given that the decedent lived and was allegedly exposed in those states.

In an Aug. 9 order, the Philadelphia Court of Common Pleas granted CRC Industries Inc.’s motion to dismiss on forum non conveniens grounds, dismissing the case without prejudice to re-file the action in South Carolina or North Carolina.
