Exactech Moves for Summary Judgment in Tenn. Federal Hip Implant Case

KNOXVILLE, Tenn. — Exactech Inc. has moved for summary judgment in a case targeting its AcuMatch hip implant, arguing the claims are time-barred under Texas law because there is no written warranty that the device had a useful safe life greater than 15 years.

In an Aug. 14 motion filed before Judge Pamela Reeves of the U.S. District Court for the Eastern District of Tennessee, Exactech contends the evidence, including sworn testimony, shows that neither the plaintiff nor the plaintiff’s surgeon relied on any such written warranty.
