Plaintiff Granted New Trial on Appeal in Mo. C.R. Bard Transvaginal Mesh Action

ST. LOUIS — A Missouri appellate court has granted a new trial to a plaintiff who alleges she was injured by C.R. Bard & Co.’s Align transvaginal mesh device, ruling that the trial court committed reversible error when it barred evidence concerning the company’s previous criminal convictions involving an unrelated medical device.

However, in the Aug. 21 opinion, the Missouri Court of Appeals denied the plaintiff a new trial as to her claims against co-defendant Boston Scientific involving its Solyx device, ruling that an error committed by the trial court did not rise to reversible error.
