Valve Defendant’s Motion for Summary Judgment in Asbestos Case Denied by N.Y. Court

NEW YORK –– Efforts by valve manufacturer Fairbanks Co. to obtain summary judgment in an asbestos case have been denied by a New York court, which opined that the defendant had failed to present evidence to support its motion.

In the Aug. 3 order, the New York Supreme Court for New York County wrote that, even if the defendant had presented evidence to support its position, it would have still would have rejected the defendant’s position that testimony proffered on behalf of the plaintiff was inadmissible.
