BHR Hip Implant Plaintiffs Permitted to Add Smith & Nephew plc as Defendant

BALTIMORE — A Maryland federal judge has allowed a couple to amend their complaint involving a BHR hip implant component to add Smith & Nephew plc as a defendant, but declined to determine at this point whether the proposed claims are futile.
In a July 31 order, Judge Catherine C. Blake of the U.S. District Court for the District of Maryland explained that allowing the plaintiffs to file an amended pleading will protect their rights, given that the two-year statute of limitations applicable to their claims expires on Aug. 18.
