N.Y. Court Denies Summary Judgment Motion from Rockwell Automation in Asbestos Case

NEW YORK –– A New York court has denied a motion for summary judgment in an asbestos case, finding that the defendant had not presented enough evidence to back its assertion that the plaintiff had failed to prove a link between the alleged exposure and the company’s product.

In the June 22 order, the New York Supreme Court for New York County found that an affidavit submitted in support of the motion was inadmissible hearsay since the defendant did not submit the catalogues mentioned in the affidavit.
