N.J. Federal Judge Upholds Authorization of Disbursement from Durom Hip Common Benefit Fund

TRENTON, N.J. — A New Jersey federal judge has refused to reconsider her authorization of a disbursement of $3.23 million from the Durom Hip common benefit fund, saying the order clearly identified CMO No. 3 as an appropriate method for disbursing the funds.

In a July 7 order, Judge Susan Wigenton of the U.S. District Court for the District of New Jersey noted that funds have been disbursed pursuant to CMO No. 3 on at least three other occasions, and that the movants failed to identify any intervening change in the relevant law or new evidence.
