Lawsuit Involving Chemotherapy Drug Tasigna to Proceed Against Novartis in Fla. Federal Court

WEST PALM BEACH, Fla. — A Florida federal judge has allowed failure-to-warn claims to proceed in a Tasigna action, finding they are not preempted because it is not clear whether the FDA would have approved a change to the chemotherapy drug’s label to warn of the risk of stroke.

In a July 9 order, Judge Robin L. Rosenberg of the U.S. District Court for the Southern District of Florida further held that the plaintiffs established proximate causation because their prescribing doctor changed his warning to patients after learning more about Tasigna’s risks.
