Former Applied Underwriters Policyholder to Appeal Confirmation of Arbitration Award

LOS ANGELES — A landscaping company is appealing a California federal judge’s confirmation of an arbitration award issued in favor of Applied Underwriters Captive Risk Assurance Co. (AUCRA).

O’Connell Landscape Maintenance Inc. filed a notice of appeal on June 6, evincing its intent to appeal the matter to the 9th Circuit U.S. Court of Appeals.

In 2013, O’Connell Landscape Maintenance Inc. began participating in Applied Underwriters Inc.’s EquityComp workers’ compensation insurance program. The program consisted of workers’ compensation policies issued by AUI affiliate California Insurance Co. and a reinsurance participation agreement, through which O’Connell participated with AUCRA.
